We would like to introduce you to the General Terms and Conditions that we apply for processing and further handling of a purchase. BELMILAN GmbH, Im Großacker 54, 79252 Stegen (“Belmilan”, “we”) produces high-quality wines and operates the website www.belmilan.com (the “Website”). Here, individuals and businesses can order our products and have them delivered to their homes.

§ 1 Scope

1.1. The business relationship between BELMILAN and the customer is governed exclusively by the following General Terms and Conditions in their version valid at the time of the order. In the context of commercial transactions, differing conditions set by customers are not recognized unless we expressly agree to their validity in writing.

1.2. The sale of our wines via www.belmilan.com is currently only within Germany. Therefore, the delivery and billing address of the customer must be located in Germany.

1.3. Only adult customers may place orders. Only consumers have the right to cancel under § 6.

§ 2 Conclusion of Contract

2.1. The presentation of our wines does not constitute a binding offer. Only the customer’s order as per § 2.2 is considered a binding offer to conclude a purchase contract in the sense of § 145 BGB.

2.2. By clicking the “buy now” button, you submit a binding purchase offer. After ordering, you will receive an automated confirmation, which does not yet represent a binding acceptance of the offer on your part. This confirmation is only for documenting the successful transmission of the order. A contract with us is only concluded by the shipment of the goods or by sending an acceptance declaration, which we will send you as a separate order confirmation via email.

2.3. Our wines are sold only in household quantities.

§ 3 Prices and Shipping

3.1. All prices we list on our homepage are in Euros and include the applicable legal value-added tax. The prices at the time of the order apply.

3.2. Shipping is at the customer's expense. Within Germany, shipping costs a flat rate of €8.90 per order. The shipment is insured and in special wine cartons. An overview of the shipping options and the resulting shipping costs can be found under Payment and Shipping.

3.3. Shipping is free within Austria and Germany for orders over €100.

§ 4 Payment

4.1. We only offer prepayment and credit card as payment methods. Payment by prepayment includes the options of bank transfer or payment via PayPal and Shopify Payments. Please note that we only accept payments from accounts within the European Union. Any costs of a money transaction are to be borne by you.

4.2. The invoice amount is due immediately upon conclusion of the contract after 2.2 and must be settled within 7 days. In the event of non-transfer or non-payment, BELMILAN may withdraw from the contract after 7 days.

4.3. We only send you the invoice electronically.

§ 5 Liability

5.1. We are not liable for defects in the delivered goods that were caused by improper storage of the wines (e.g., in rooms that are too warm).

5.2. We, our legal representatives, employees of BELMILAN, and vicarious agents are liable to the customer:

1. without limitation for damages caused intentionally or through gross negligence;

2. without limitation for damages caused at least negligently to life, body, or health;

3. otherwise for damages caused by the negligent breach of essential contractual obligations, limited to the typically foreseeable damages at the time of contract conclusion. We are not liable for the slightly negligent breach of non-essential contractual obligations.

§ 6 Right of Withdrawal for Consumers Only

6.1. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form, but it is not mandatory.

To comply with the withdrawal period, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal:

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us,

immediately and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

6.4. You will have to bear the direct cost of returning the goods. Please ensure proper packaging of the wines.

6.5. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

6.6. The goods remain the property of BELMILAN GmbH until full payment is received.

We are neither obliged nor prepared to participate in a dispute settlement procedure before a consumer arbitration board.
